Dream Big Media, Inc. ("DBM") values and respects Your privacy. We want You to use and enjoy Jinglegram.com (the “Site”) with the confidence that you're doing so in a safe environment. That's why we've created this summary of our information practices for You.

This Privacy Policy (The “Policy”) applies to the personally identifiable information collected on the Site and does not apply to any other information collected by DBM through any other means.  "Personally identifiable information" is any information that identifies a particular individual, such as the individual's name, mailing address, e-mail address, and telephone number.

Be Sure to Discuss this Policy with Your Kids. We believe parents and kids should be armed with information about how to safeguard their privacy while online. That’s why we urge You to read this Policy carefully, and to discuss it with Your kids.  This will help You to exercise greater control over the personal information that You and Your kids share while exploring and enjoying our Site.

BECAUSE MANY VISITORS TO OUR SITE ARE KIDS UNDER 13, DBM IS COMMITTED TO COMPLYING FULLY WITH THE CHILDREN’S ONLINE PRIVACY PROTECTION ACT OF 1998.

We urge You to play an active role in supervising Your kids to ensure for their safety while surfing the web. Among other things, this includes setting appropriate restrictions regarding their release of personal information online.  At a minimum, we recommend that You tell Your kids never to share their name, address, phone number, passwords, and/or other personal information (including photographs) with any online service provider and/or any person they meet online, without Your direct involvement and permission.  In addition, we highly recommend that You consider using one or more of the parental control software tools and services available to help provide a safe online environment for Your kids. These tools can restrict Your kids from otherwise disclosing personal information without Your permission.

What Information Do We Collect from Kids? At DBM, we take the utmost care to ensure that kids who use our Site only access content that is appropriate for them.  And we strictly limit the collection of personal information from kids under the age of 13. DBM DOES NOT CONDITION A CHILD’S PARTICIPATION IN ANY OF OUR ONLINE ACTIVITIES ON THE DISCLOSURE OF MORE INFORMATION THAN IS REASONABLY NECESSARY TO PARTICIPATE IN THE ACTIVITY.

Our Site offers family-oriented content, and is INTENTED TO BE ENJOYED BY KIDS WITH THE SUPERVISION AND PARTICIPATION OF THE SPECIAL ADULTS IN THEIR LIVES.  Kids can surf Jinglegram.com, view most of the videos, and play most of the games on the Site without any personal information being collected whatsoever. In limited cases, a product, service or application available on or through the Site requires the registration of personally identifiable information, including: the download of any screensaver, ebook, video, game, and/or application; subscription to any electronic newsletter or ezine; participation in any contest or sweepstakes; sending Jinglegram™ Greetings to one or more recipients; forwarding the Site or a greeting to a friend; and/or posting information to any public forum, chat room, and/or other venue that requires the inclusion of an individual’s full-name and/or email address.  In all such cases, a kid under 13 may only access such product, service and/or application UPON THE DIRECT REQUEST OF A PARENT OR LEGAL GUARDIAN OVER THE AGE OF 18 WHO REGISTERS ON THE KID’S BEHALF WITH HIS/HER OWN PERSONAL E-MAIL ADDRESS. 

AT DBM, OUR INTENDED COMMUNICATIONS ARE AND WILL CONTINUE TO BE WITH THE PARENTS AND/OR LEGAL GUARDIANS OF KIDS UNDER 13 – ON BEHALF OF SUCH KIDS.  We will never intentionally request the full names, email addresses, and/or other personally identifiable information of kids under 13 years old without first instituting appropriate procedures to gain the appropriate parental consent. And, we will never knowingly ask kids to disclose more personal information than is necessary for them to participate in a particular activity.

DBM assumes any products purchased online through credit cards, PayPal, and/or any other means, are purchased by adults over 18 years of age. IF YOU BELIEVE THAT YOUR CHILD UNDER THE AGE OF 13 HAS SUBMITTED PERSONALLY IDENTIFIABLE INFORMATION TO DBM, PLEASE CONTACT US VIA E-MAIL OR POSTAL MAIL (TO THE ADRESS PROVIDED BELOW) AND WE WILL IMMEDIATELY DELETE SUCH INFORMATION FROM OUR ACTIVE DATABASE.  Please note that in such cases it is possible that non-personally identifiable information may remain archived in the DBM web log archives after we delete the personal information from the active database.

What Information Do We Collect from Adults? DBM collects personally identifiable information from adults only when you specifically and knowingly provide such information to us, including when You:  order Jinglegram™ Greetings; join our Jingle Club Mailing List; download any digital products or applications (including screensavers); enter any contest; subscribe to any newsletter, e-zine, blog update; utilize any service; subscribe to any promotion; send us an e-mail and/or call us. This information typically includes Your name, Your e-mail address and/or Your phone number.  If You choose not to register Your information in these cases, You may not have access to the Site content, service or application in question.

In the event You purchase a product or service, we may also collect necessary billing and contact information to process Your order, including Your credit card number, PayPal account, and/or other financial information. DBM may use third parties to accept and process orders and credit card purchases for merchandise and products. If You purchase a product or service through a third-party site linked to Jinglegram.com, such as Spreadshirt.com, You may also be subject to the terms, conditions and privacy policies of such third parties.

In some cases, DBM may collect information that You provide to us about other people, including the name, e-mail address, age, gender, personality traits, interests and other key factors required for us to complete a personalized Jinglegram™ Greeting sent by You. We only use the information You submit about other people in order to create and deliver the greetings specifically ordered or requested by You and/or to facilitate a request to forward our Site link to a friend.  We will not communicate with or contact the recipients of Your Jinglegram™ Greetings for any other reason.

How Do We Use the Information We Collect? The information we collect is intended to support our relationship with You, by helping us to deliver more targeted, relevant products, services, advertisements, promotions and Site content. In all cases, we strive to maintain and use the information we collect in a responsible manner.

DBM may use Your personally identifiable information in several ways, including fulfilling customer orders; communicating with Users and Guests; providing customer service; enhancing and improving Your experience on the Site; completing credit card transactions (where applicable); and sending You special offers and promotional materials that we believe may be of interest to You, and for which You have opted-in. This might include, for example, communications that directly promote new products, features, services, special offers, updated information, contests, and/or third-party products and services. 

In order to provide many of our products and services free of charge, we display advertisements on the Site and encourage You to participate in opt-in mailings. We may also deliver advertisements, promotions and offers by e-mail and/or through screensavers to people who have opted-in to receive such messages.

In some cases, promotions that are offered on or through the Site may be sponsored by companies other than DBM. Such third-party offers and promotions will be subject to applicable privacy policies and terms of those companies. In addition, in some cases, DBM may disclose Your personally identifiable information to our trusted business partners, affiliates and/or sponsors so that they may send you special offers and promotions.

By accessing this Site and providing DBM with personally identifiable information about You, such as Your name, mailing address, and phone number, you understand and agree that you may receive from time-to-time, promotion-related emails from DBM, and in some cases, its sponsors, affiliates and partners – unless You opt-out of such promotions. This may occur, for example, when you use a product, service or application on the Site that requires You to provide personally identifiable information, such as sending a Jinglegram™ Greeting; downloading an ebook; downloading DBM screen savers or other content; and/or downloading or utilizing any other third party software.  

If You make a purchase from a merchant associated with DBM, such as Spreadshirt.com, the information obtained during Your visit to such store, and the personal information you provide, such as Your credit card number and physical address, will be provided directly to such merchants. This is to enable transactions to be fulfilled.

Sponsors, partners and affiliates associated with DBM have their own separate privacy and data collection practices. DBM assumes no responsibility or liability for these independent policies. For more information regarding our sponsors, partners and affiliates, visit their respective websites and click on their information or privacy policy links, if any.

DBM may disclose Your e-mail address to its partners, affiliates and/or sponsors as part of a suppression file or do-not-e-mail list, in order to ensure that Your unsubscribe requests are forwarded to the appropriate parties; and Your removal from our partner, sponsor and affiliate databases takes place swiftly in compliance with the Can-Spam Act of 2003. YOU MAY OPT-OUT OF RECEIVING PROMOTIONAL EMAILS FROM DBM AT ANY TIME AND FOR ANY REASON, as described further below. 

In the event that either DBM or Jinglegram.com is acquired, in whole or in part, by another company, User/Guest information collected on or through the Site, or any service or application thereof, would be considered a valuable business asset that will be fully transferable and assignable.  

What Technology Does DBM Use to Collect Information? DBM collects certain personal information through technology in order to make our Site more interesting, appealing and efficient for our Users. For instance, when You come to our Site, we collect Your IP address. An IP address is not personally identifiable information. It is typically associated with Your internet service provider. We use Your IP address to gather broad information about the frequency with which Users visit various parts of our Site and to gather aggregate demographic information about our Users. We may also use it to better administer and optimize our Site, diagnose technical problems that may arise, and better serve Your needs.

Our web servers do not automatically recognize Your e-mail address, but we do collect Your e-mail address if You communicate with us via e-mail or You opt-in to one of our programs, promotions or mailing lists. We collect aggregate information on the web-pages You access or visit, and information that You volunteer, such as survey information and/or site registrations. This information is used to better serve You through the creation of more customized content, more tailored Site designs, and more targeted marketing offers for which You have opted to receive. If You are not a registered user of the Site or if You have elected to Opt-Out of receiving email from us, we will not use the information from our web logs to market to you.

Our Site also uses Cookies. Cookies are small piece of information that a website stores as a file on Your computer. Cookies do not contain any personally identifiable information, but may record session information, such as items that You download or add to a shopping cart (where applicable).  You have choices with respect to cookies. You can use Your browser to turn cookies on or off.  If they are off, You won’t have access to some features that may make Your experience on our Site more seamless and convenient.  Please note that cookies cannot damage User files, pass on computer viruses, capture e-mail addresses or read information from a User or Guest’s hard drive.

In some cases an outside company may serve third-party advertisements on our Site. These advertisers may store their own cookies in Your cookie file and use the information to serve advertisements that are more targeted to goods and services that may be of interest to you. By delivering ads on the Site, third-party advertisers can record the ads You have seen and the pages on the Site You were viewing when the ads were served. Third-party advertisements only collect information that is not personally identifiable.  DBM does not have access to the information collected.  

How Can I Change My Privacy Preferences? If You have opted-in to one of our programs, promotions or mailing lists, You can change Your mind at any time. All of our communications will have an “opt-out” link on the bottom.  When You click the opt-out link and follow the instructions provided, we will remove You from our mailing lists, and You will not receive future mailings from us.  Please note that it may take between 2 and 3 weeks to ensure Your email address has been deleted from all of our lists.  If after 3 weeks you continue to receive promotional material from us, please contact us personally via email or letter (to the address provided below) and we will take steps to manually ensure your information is removed from the lists. If You would like to re-subscribe, You may do so right on our Site.  

In certain cases, DBM may use Your information to fulfill transactions requested by You that are unrelated to promotional materials: such as Your purchase or request to use or download a product or service offered on the Site; to send You administrative communications about the Site; to respond to customer service inquiries; and/or to inform You of any future changes to the Terms and/or this Policy.  In these cases, the opt-out provision does not apply. DBM reserves the right to include promotional materials to accompany the fulfillment of the delivery of any products or services requested delivered on or through the Site.

In some cases, DBM may share aggregated demographic and statistical information with other partners, affiliates and/or sponsors,  that is not linked to any personally attributable information.  

How Secure is the Information I Provide to DBM? If and to the extent we accept credit card payment for any product or service, we are committed to using the highest quality industry-standard encryption technologies when transferring and receiving consumer data. This said, in many instances our services are free of charge and credit-card processing is not required.  All products sold through the Jingle Store are subject to the terms, conditions and security policies of Spreadshirt.com, our third-party vendor. 

At DBM, we use our best efforts to protect Your personally identifiable information. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% safe and secure. As a result, DBM cannot and does not ensure or warrant the security of any personal information that You post online, send to us, or transmit on or through our Site.  You agree that any data transmission You make, send or post on or through the Site is at Your own risk. 

DBM may offer chat, user forums, games, bulletin board, and/or other public functions. Please note that any posting by You (or anyone using Your email account and personal identity) is considered to be public information available to other Users, Guests and visitors to the Site. All such postings are governed by our Terms.  Please note that whenever You voluntarily disclose personal information in an online public forum, it is possible that it will be harvested and used by unintended third parties.  This means you may receive unsolicited emails and/or other communications from unwanted third parties.

It is Your responsibility to be prudent when publicly posting or providing others with Your email account information, passwords, and/or other personal information.  Please take great care not to use personal information in Your screen-name or other information that might be publicly available to other users.  And please, reinforce these safety guidelines with your kids!

You understand and acknowledge that while DBM does not pre-screen any content posted by You, or other Users or Guests, we retain the right, in our full discretion, to refuse to post or to remove any content from the Site, or to refuse to transmit any content that is deemed to be objectionable (in our sole discretion). DBM also reserves the right to investigate reports of misuse of all services and applications; to protect the property and assets of the Site; and to protect our Users and Guests from any content deemed to be objectionable or harmful.

DBM reserves the right to disclose any or all of the content posted on or through the Site, or any service or application thereof, to any third party (including, but not limited to, the intended recipients, their counsel and/or law enforcement authorities).  Disclosed information might include the sender's name, account information, user identification and cookie numbers, transmission data, past and subsequent service use records, billing information, and any other information deemed necessary under the circumstances, to be determined in the sole discretion of DBM. Additionally, DBM may provide certain information to other individuals or organizations for fraud protection and credit risk reduction purposes. These disclosures may be made with or without notice to You. By using this Site, You irrevocably consent to such disclosures and DBM will have no legal liability for such disclosures. 

Are the Jinglegram™ Greetings I Order Confidential? We will not intentionally share the information used to create Your Jinglegram™ Greeting under any circumstances.  However, YOU SHOULD HAVE NO EXPECTATION THAT THE SENTIMENTS EXPRESSED OR OTHER DATA USED TO CREATE YOUR JINGLEGRAM™ GREETING WILL REMAIN CONFIDENTIAL, AS ALL USERS, GUESTS, AND RECIPIENTS OF SUCH GREETINGS HAVE THE ABILITY TO FORWARD THEM TO FRIENDS AND FAMILY MEMBERS (FOR NON-COMMERCIAL USE), AND FRIENDS AND FAMILY MEMBERS MAY ALSO ELECT TO FORWARD THE GREETINGS TO OTHERS.  Greetings are not password protected or maintained on a secure site.

Do Any Other Information Policies or Practices Apply? DBM may feature links, advertisements, and/or product offerings by third parties on the Site, or on any related websites owned or controlled by DBM; or in any newsletters, e-zines, e-books, blogs and e-mail communications.  These links, advertisements and/or product offerings may appear in the form of banners, buttons, text links, integrated gift services, or otherwise. THE GOODS AND SERVICES AVAILABLE THROUGH THESE LINKS, ADVERTISEMENTS AND PRODUCT OFFERINGS ARE PROVIDED BY INDEPENDENT COMPANIES, WHICH ARE NOT AFFILIATED IN ANY WAY WITH DBM AND DBM MAKES NO REPRESENTATIONS AS TO THE INFORMATION PRACTICES AND PRIVACY POLICIES OF SUCH ADVERTISERS, SPONSORS, AFFILIATES, PARTNERS, VENDORS, And/or OTHER THIRD PARTIES.  In cases where access to the Site is provided by a link or banner ad located on another website, DBM makes no representations and gives no warranties with respect to the information practices or privacy policies applicable to such sites.

Can DBM Make Changes to this Privacy Policy?  DBM reserves the right, in its full discretion, to change, modify, add to, remove, or otherwise alter this Policy, in whole or in part, at any time and from time to time. Such changes will become effective immediately upon the posting thereof on the Site.  Please review the revision date at the bottom of this page periodically to determine if the Policy has been changed since You last reviewed it. Your continued use of the Site following the posting of changes and/or modifications will constitute Your full acceptance of the revised Privacy Policy, and all the terms and conditions thereof.

If any provision of this Policy shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the remainder of the Policy and shall not affect the validity of any remaining provisions.
